I am currently on H-1B visa and have applied for permanent residence under EB-3 category. My labor certification was approved and I have filed for I-140 and I-485 concurrently in Oct 2004. My husband came to US 8 years back on F-1 visa and converted it to H-4 visa 5 years back. Meanwhile he worked for a company as a car salesman.Out of the 5 years on H-4 he worked in Canada for 2 years and holds permanent residence in Canada. We are getting ready to file for his i-485. We filed Labor certification in Jan 2002 but the whole process of collecting info etc started in Apr 2001. Please let me know what are my husband's chances of getting i-485 approval and also do we need to mention employment history in the i-485 application. My employment history is straight and we are hoping my i-485 will be approved with no issues. Pleas help us in this regard. Is my husband eligible for 245 i etc.. My husband might have worked without authorization for atleast 16 months. There is no point in me getting Green Card without my husband getting it. We have US born daughter 2 years old. Please let us know what to expect and what we can do to get my husband's i-485 approval. Your advise will be sincerely appreciated. Thanks
