Please Help !! I-140 RFE from TSC

Hi Gurus,

Please share your thoughts. My labor was approved through PERM in EB2 category. I have BS with more then 8 yrs exp. Since my work experience is distributed with technical and non technical. I recieved an RFE requesting additional evidence as to all progressive experience must be in IT. My attorney says that there is no such rule to have a mandatory 5 yrs of experience in IT. It can be combination of experience.

Have anyone encountered the same issue.. Please share.

what does the job requirement say??? how many years and does it say experience in related field??

The job requirement is programmer analyst. Experience in related field says 6 months. I have more then 2 1/2 yrs of programming experience.
 
According to my understanding, If the job requires a master's degree in computer science, if you don't have a MS degree, then you need to have a BS degree and 5 years experience in computer science related field. If you don't have 5 yrs in a computer related field then it might be a problem. You can ask your employer to write a letter saying They consider your experience to be related exp. Other that that I don't know what else to say...

So as per yor opinion with in 60 days we will get the approoval.Am I right?

Mine is an I-140 for shcedule A Job.RFE recieved by TSC on 06 Sept 06.LUD is on 14 sep 06.After that there is no update .Any body have direct contact number or e-mail of TSC.Please update on the portal.

I am also in similar situation only difference is i am yet to file. The job requirement is the same programmer analyst.but my Hr is convinced i am a potential Eb3 case. While my labor is certified with BS+5 yrs+4 months experience.and 1 yr of that experience is during my final year BS. can i claim Eb2.Will it be wise to push my lawyer to file 140/485 and go along with Eb2 and see.If it doesnt get approved for eb2 then file perm and file next stages concurrently.Any inputs.
