PLEASE HELP: I-140/485 submitted separately

Hi all,

My I-140 was submitted in jul 2002 and the I-485 in Jan 2004.
I have enquired the USCIS to give me a status on my I-140 application at vermont Service Center. I was put through to an immigration officer. She told me repeatedly that either the I-140 should be submitted along with the I485 together OR I-485 should be submitted AFTER the I-140 approval.She advised to withdraw the 485 and re-submit when I get a approved i-140.

I do not have the I-140 approval yet but have submitted the I-485.Are there any cases of i-140 and i-485 ( which have received approval) even though they were submitted separately?

I am moving to NY from CA but will be within the same company.The i-140 was submitted with a substitution labor from CA. In order for me to have a valid status, the lawyers advised that i apply for the I-485 and stay in CA for 6 months and then make the move.

If this 485 is not valid, then how is this going to help me?
I am so confused.PLEASE HELP.

I don't think so that there is any problem or issue sending I-140 and 485 seperatly (you do have receipt# and receipt copy).... you already filled I-140 before filling 485. and at the time of filling 485 it would be considered as concurrent filling because I140 is in pending..... doesn't matter u send them onebyone... one of my friend case 140 was sent in june/May 2002 when the concurrent opertunity became law. and 485 was fillled in 2003.... as concurrent application.

140 was approved in late 2003 but 485 still in pending .... wo there is nothing wrong ur filling....

what does ur online 140 status shows????? if current 140 processing date where u filled, is greater than ur 140 process time frame .... then send them written inquery telling that you are processing i.e Jun 03 I-140 cases.... my case was filled blah blah date... anyting u sent send it through attorney (either ur personal or company). you will get response (don't confuse them telling my 485 pending..etc etc.... ). just talk about 140 they know what is there in their computers.... thats whay they advised u to withdraw 485.... why did u inquire about 485 when ur concern on 140....??? did u mention them about concurrent filling.... ??????

this is good to follow ur pettiton and concerns about case.... but always try to use ur attorney and in written.... once I remember I called them they were advising me to file G-28 blah balh form to change of ur attorney..... to make inquery ....

Go to your attorney if company pays fine... otherwise pay from ur pocket make good relations.... ($$ works) ask them nicely to send inquery in writting ans give copy to u.... they are obligeted to follow ur pettition if there is any issue....

there is 50k plus calls (according press relase ) to service centers.... for inquering... the best way is 'WRITTEN' fax them and send one copy in mail. (rememebr they will takecare/look at inquery when they see that theri current processing date is far ahead aprox 15/30 days, than date in ur receipt no. so don't mention/ask about ur 485 inquery they may ignore it. don't confuse them asking so many question realted about ur 485.... blah blah... ur future moving address ur other concern..... u und what I am saying??.... just send a simple inquery telling them that ur current processing time has come far ahead then my receipt # and processing time frame.... they will listen u.. and understand..... )


(Always make copy of our all pettition/doc/RFE you or ur attorney send to them....ALWAYS ALWAYS ask/make copy for ur personal records you may need in future).

Yes, the processing dates are now Oct 2002 and mine was filed in july 2002.Thats why i am restless.
