Please Help - H4 transfer

Recently I changed companies and my H1b transfer was filed.
For some reason my attorney did\'nt apply H4 transfer for my wife and kids.
Now when I ask him to apply, he says that it is better to wait till my H1b transfer is done and then he would apply for H4 transfer along with a copy of my new H1b. In this case there is less chance of messing up my wife\'s H4.
Is it okay to proceed like this or not?
Will her stay here not become illegal?
Although she has the previous H4 valid till Jan of next year, what happens if my previous employer cancels my h1b?

Please advice. Any help is appreciated a lot.
 
Your lawyer is absoloutley right

Don\'t worry , your spouse status is fine as long as her I-94 is valid . Once you get your new H1 then apply for your wife H4 based on new H1
 
You do not have to apply new H4 as long as the I-94 is valid

We are in the same situation. I changed work in March 2001. We had trip to overseas during the new year (from Dec. 2001 to Jan. 2002)with my new H1 approval notice (original)and old visas ( with name of previous company ). We surrended I-94 at port. When we returned the new I-94s were issued base on my new H1 approval notice.
