Please Help! H1B expires Oct1, applying for EAD & 485 Nextweek

Hello all,

My H1b will be expiring on 1 Oct 02 and my lawer will be applying for EAD next week. I am pretty sure that EAD will not be issued before the expiry of my H1b. When I contacted my lawer he says that I will not be out of status since we would have applied for 485.

Can I apply for an Intrim EAD, is there a possibility for approval?

Can I apply apply for extension of H1b, my lawer says that we cannot apply for H1b extension since we are applying 485.

Please advice me of anyother options.

after 90 days interim or temp ead can be got. after applying for 485 ur not out of status

Need good judgement from you

Now a days people are getting EAD'S within 60 days after applying for 485.

You can apply for H1B extension even though you are applying for 485.

Once you applied for 485 you can legally stay in US even after expiry of your H1. Only thing is you can't work.

If you want to work, you must have either an EAD or a valid H1 visa during the period of 485 processing.

If you apply for 485 and EAD and not applying for H1 extension,
incase you don't get the EAD before your H1 expirty date,
take leave for some time until you get you EAD.

Most probably you will get within 60 days from your Receipt Date.

Other wise you can get the interim EAD after 90 days of your Receipt Date.
