My company is thinking on promoting me to a manager position, changing visa from H-1B to L1A. Since I worked for the same company since 1998 out of the US, back in my country of origin. When the laywer submitted H1b back in 2001 he thought, I never worked for this company previously.
The question now, is that he says that it is possible to change to L-1A, however it is too risky, because USCIS could reject both L-1A and H1-B.
Is this possible?. If they reject L-1A would I loose the H1-B?. The company started LCA for me on Feb 2004, would all that process be gone if they reject L-1A?
