Hi,

I am about to file my 485. Back in 1998 my previous employer applied for my H1 and that year H1 quota was over sometimes in May. And i had to go back to school for five months. And then my h1 got approved . In that time frame when i was in school i had to work outside for my living . Please suggest me when i applied for my 485 do i have to mention that? Though i was never out of status.
 
Suggestion

I strongly suggest that you get a good lawyer to help out in filing of 485 and have a game plan on how to address different issues. It is hard to say what would be the best approach in your case, but with a lawyer you can devise a game plan both ways.
 
Be truthful

You have to be truthful in what you answer on the forms, but you don\'t have to tell them something which they are not asking. You can discuss this with your lawyer. INS checks the dates for being out of status - they do see past Income Tax forms, but I don\'t think that IT forms are scrutinized heavily.

I talked to my Lawyer and let her know about the stuff. And i was never out of status. I know quite a few friends of mine work outside while in school and they got their gc (485) approved. And in the form they never mention about those job. Any input will be appreciated.
