Please Help - EAD Renewal Delays!!!

Hello Gurus,

My I485 is pending and my current EAD is expiring on 08/29/2004. My EAD renewal form (I765) is filed on 06/15/2004 (Receipt date). My question is as follows.

If I do not get the new EAD card by 08/29/2004 what will be legal implications in terms of my employment status etc...? :(

If you could answer this question, I will be obliged.
 
It is absolutely, positively ILLEGAL to work without an EAD (of course unless you have some other form of authorization like H1B). You would have to get an unpad leave of absence, or a vacation. If there is no action on your EAD until Sep 15, then you can go for an interim EAD. If you get an action, including a request for evidence (RFE), then your local office may or may not issue you an iEAD (depends on the local office).

You cannot work after your current EAD expires till you get the next EAD card in your hand.

Your status on the other hand is OK as you have a pending 485 -- so you can stay in the US (and can even travel on AP).
Best is to ask your employer to put you on an administrative leave without pay.

BTW, which service center did you file your EAD in ? The time it takes would depend on that.
Also was it e-filed or paper filed ?

My Service Center is Nebraska. They are saying it takes about 90 days to get the EAD approved.

My company is ready for any legal alternative so most probably my management will decide to put me on Administrative leave.

What I was mostly worried about is my status and any harm this may cause to my I485 processing.

I had applied for a renewal on May 20th at NSC and my case was approved on July 27th. Your case should be approved soon :)

My EAD was applied at NSC on June 1st and approved on Aug 3rd....
so its about 60 days or so .... maybe you'll get lucky and get it earlier ???

Next time, apply atleast 100 days in advance :)
 
Thank you Max2k1 and minn_labor for your optimism.
From next time (hopefully my I485 will get approved by that time) I will remember to apply for EAD renewal at least 100 days before Expiration date.
