I had a DWI (misdemeanor, not a serious accident or anything) 5 years back, and now won a DV lottery 2009. I will be doing AOS.
Please advice if there will be any problem during the process? Also do I need any document/police certificate etc. for this matter?

Thankkkkks.

You mean DWI as Driving While Intoxicated?

DWI is not consider a crime but it is against the law. As far as I know, it doesn't make you a criminal unless you killed someone while driving. Mostly it showed how bad and irresponsible driver you are.

Will it become a problem? It will depends how serious your offence is. Did the police just caught you in the street and gave you a citation, or did the police suspend your liscence, or did the police arrested you and put you in jail?

DWI or DUI is quite common in the U.S. It mostly will affect your driving record and your driving privileges. If you have been arrested, you need to show to the immigration officers the police record when you're arrested and also the court order . Show these documents when they ask you if you have been arrested and try to explain to them.

I can't tell you if it cause any problem for the process. It is for the immigration officers to decide. All you can do is prepare all the paperwork from that case.

DUI charges goes to one's character. Not sure how it effect DV category, but in other type of immigration; "good and moral" character is supposedly a requirement. Most of the time if charge with a DUI, the person in charges is fingerprinted and thus have a record..... Just my opinion.... I think a DUI record will likely be viewed differently in Consular Processing (CP) compare to Adjustment of Status (AOS). I can not tell you which is better or worse, but I will advise to investigate more. If you are in the US, I will suggest you should consult with a very good Immigration lawyer (average rate $100-200/hr), who knows DV requirements, for about an hour to get an idea about the best course to take. You do not need any more than 1 hour... otherwise you are wasting your money. Best of luck

Thanks for the valuable reply guys. I did got arrested and spend 4 hours in jail. It was a light sentence, license suspended for 6 months.

Usually you need to contact either your local police station or the State police headquarter. Call them and ask them how to request the documents. It is different from State to State.
