HI ALL

im green card holder through marriage ( conditional green card ) ... i went over seas and came back to US with no problem ... now things are not going well with my wife . my question is :


1- if i divorce her can i still travel with no problem or my card will be revoked ?

2- if i get married with other spouse can i tarvel at the same time while we file to uscis ...

3- if i didnt divorce and things getting better between us . can i go back home to stay 4 months ( and i just got back from home last month )))))) i have heard i have to spend 180 days in usa out of 360 days ..


please help and advice .. i have called and visit lots of lawyer with no sence ... its waste of money ....


your advice will be appreciated

i didnt travel for 4 month .. i just said im planing to travel . we travel together for 3 weeks last month ...

Do you want a GC to travel? or to live/work/study in the US?

How long ago did you receive the GC? How long have you been married?

1) Your card will not be revoked.

2) You do not have to file anything to USCIS if you marry someone else, you will have to remove the conditions on your Conditional Residency by filing I-751 by yourself, but your new wife has nothing to do with that.

3) For as long as you spend less than 1 year outside of the US, you are fine. If you plan on spending a long period of time though, I would file an I-131 just to be safe.

Not quite true. By showing intent to abandon US residency (e.g. by taking up residence abroad, foreign employment etc) its possible to lose your LPR status much quicker than 1 year. Most of the time however, officers inspecting you at a PoE typically don't start giving you a hard time unless you've been out between 6 months and 1 year.
 
Well, he stated that we wanted to travel as in tourism I presumed. Of course you should not take residency or employment. But again just to be safe if you are to stay over 6 months, file an I-131.

And do not blame your wife for leaving you if you leave her for 4 months. :rolleyes:
