Please help and advice...I\'m in trouble

My I-485 is at VSC (EB1 OR...employer based, RD and ND Jan 01). I\'m currently on H1 eventhough I have EAD card. My company is going to be sold out in 2 weeks and the new company is getting rid of all the employees and just taking over the technology.

Considering limited time..what are my options. As I mentioned..I\'m on H1....and will be out of status once i am out of job. In my area its difficult to get a job in the same classification soon. What should I do...I do have EAD which wasn\'t used. Please help. Would i be considered as out of status if i\'m without job.

You have an EAD, it seems it is 180+ days since your 485 was filed. What more could one ask for in this situation?

I know losing a job is stressful, but you can use your EAD to get another, even more than one job. You will not be out of status because you have an EAD. Nobody does an H1 transfer these days, almost nobody. But your EAD is the solution to your problems. Once you get a new job, make sure you consult an attorney and inform INS of the new employer.

In fact your old employer is reneging on the "future job" concept of GC.

   I totally agree with virochan. He is 100% correct in his analysis. You are absolutly covered by the AC21. After filing I-485 nobody will be out of status, if one is not taking up unathorized job. In your case you have EAD which you can right away to work with another employer.

I agree with the two messages above, but I have some concerns here. Not that I am trying to discourage u, but for your sake only.....You said "In my area its difficult to get a job in the same classification soon"..... AC21 clearly states that your new job should be in the same classification as the previous one. So when you join your new job using, just as a precaution ...make sure that it resembles the job description close to your immigrant petition. You need to check O*Net job classification for your area of expertise.
