My I-140 is likely to be denied based on education (inconsistent with labor col 14/15).I am in my 8th year H1 ext..and my H1 expires in Aug2007. What options do I have to extend my H1?
From reading i understand the following possibilities
1. Appeal for I140 denial..in the meantime apply for H1 extension..does anyone know how much time it takes for appeal to be replied? I know the result is going to be mostly negative..but I just need time to apply for H1 extension and get it.
2. Apply for new Labor and then apply for H1 extension..but do I have time to apply for PERM process (I have abt 1 month before my H1 expires) now?
3. Reapply I140 (regular processing to get some time to apply for H1 extension)..can this be done? But , again the question here is that since it is approved based in GC conditions, will they revoke the H1 after the GC denial?
Can any comment on these options and suggest possible options...
