Please evaluate for EB1

Dear all,

I would like to get some feedback to see if qualify for EB1 OR or EA.
I already have my EB2 NIW approved from 2007. I can't wait for the priority date to become current, so if I stand a decent chance I would like to apply for EB1.

-Ph.D. in Biological Sciences from a decent university in the US.
-Masters done in a good university in Canada
-1 year postdoc experience in the US university.
- 1 year industry experience.
- 13 publications in peer reviwed journals (more than half as first author)
- More than 15 conference presentations.
- About 15 citations for all my papers.
- Reviwer for 5 good Journals with about 8 invited paper review so far.
- Full Member of Sigma Xi, and another fellowship, quite competitive.

I am currently a postdoc on H1b and I have a job offer as an associate prof in the US starting Aug 2010.
I can get about 7-8 strong reco letters.
I don't want to wait till Aug to apply.
Do you think I can apply?

wait till Aug and ask the university to apply in EB1-OR. or ask the university to apply for you in EB1-OR now with your Asst-Prof acceptance letter.
Anyway, you can always improve the resume in the mean time if you wait, i mean you can write more papers, get more citations may be more funding. EB1-OR works well for univ faculty positions

Do you think I can apply?I am not an expert in your field so it is hard to gauge if your credentials would add up to "1) is one of that small percentage who has risen to the top of his or her field of endeavor. and 2) must have sustained national or international acclaim in the field of science, which must be recognized in the form of extensive documentation." You are the best to decide if what you have achieved places you in the top 5% of all biological researchers in your field


As far as your credentials that you have mentioned. It seems you are claiming the following categories:

* Membership in associations in the field that demand outstanding achievement of their members, as judged by recognized national or international experts;- Full Member of Sigma Xi, and another fellowship, quite competitive. Sigma Xi will hold little or no weight. The other one is unclear
* Evidence that the alien is a judge of the work of others in the field;- Reviwer for 5 good Journals with about 8 invited paper review so far.: does this put you in the top of your field?
* Authorship of scholarly articles;- 13 publications in peer reviewed journals (more than half as first author): How does this compare in your field? - About 15 citations for all my papers.: That doesn't seem like much but maybe it is in your field. -

More than 15 conference presentations.: Not sure where you want to claim that

The thing with EB1EA is that you need to prove to USCIS that you are at the top of your field as compared to everyone in that field. For NIW you just had to prove that you were better than average. As you know the difficult part for NIW is to prove the waiver part. For EB1 it is hard to convincingly prove that you are at the top. What I have seen f.i. is that people get rejected because they claim that the fact they have few publications is normal in their field but then USCIS compares their pub list to that of their Reco letters. If they then see that everyone who is recommending them has ten times more publications they say that obviously this person has not risen to the top of their field. As with any application the way you present it will be very important

My case is somewhat similar to that of getEB1. I too have an approved NIW-I140 petition from 2008. Given that the I485 priority date is stuck in January 2005 for persons from India, I am planning to apply again in EB1-EA. Here are the details of my case:

1. PhD in Mechanical Engineering from a decent university in the U.S. in 2005.
2. First post-doc at the University of Delaware 2006 - 2008.
3. Currently post-doc at the University of Florida.
4. Four (4) published articles in respected journals. Working on two more.
5. Dismal citation record.
6. About 6 - 8 conference publications and presentations.
7. One invited talk at LSU.
8. Can get about 12 - 14 letters of recommendation from top scientists from agencies such as NASA, government labs, U.S. Army labs and American and European universities.

Could you please evaluate my case in a brutally honest manner? I would greatly appreciate any feedback enabling me to make this critical decision.

Brutally honest: from what you have submitted here you could only claim 1 criterion (and not very convincingly since you have to prove you are at the top 2% or so of your field.) :

6) "Evidence of the alien's authorship of scholarly articles in the field, in professional or major trade publications or other major media."

You need 3 to qualify for EB1EA. Maybe you could claim more but you haven't mentioned that yet. Your points 1-3 don't count for anything. Nor do points 5 and 7 in my opinion.

On the other hand: It will only cost you about 1500 to apply for EB1 (assuming it's just you). Since you already have the NIW you don't have anything to lose but money by trying. You already know the drill as far as paperwork etc goes.

I am a newbie to this forum. I am thinking about self-petitioning for EB1-A and would like some of the experienced members to please provide their inputs. Here are my credentials:

Ph.D and M.S from US and B.Tech. from India
Working as a Post-Doc at a US State University

Research Activities: I have worked on projects funded by US Department of Agriculture (USDA) and National Science Foundation (NSF). None of these proposals were written by me. But I have publications out of these.

Proposals Funded: 1 by state of Ohio, 1 by NSF, and 1 by an Industry.

Professional Memberships: Members of Sigma Xi and a member of 3 more international professional organizations.

Awards:
2 International level fellowships for graduate research (one them the best a graduate student can get in my profession).
University Presidential award for research (dont know if this counts)
4 awards total for best research paper and presentation at international conferences.

Peer-Reviewing Experience: Reviewed 3 papers total thus far.

Publications: 1 Patent, 7 peer-reviewed papers (does not include submitted papers), 4 book chapters, and 20 international conference presentations - all of them as 1st author.

Citations:
around 100 (not including self citations)

Articles about me:
2 articles in trade journals describing my research.

Recommendation Letters (expected): at least 10 (including 1 from Government Scientist and 4 international).

Would I qualify for EB1-EA?
As a Post-Doc I do not qualify for EB1-OR. Am I right?
