Hi Gurus,
I read the chat on www.murthy.com on 6/3/2002. The following is the part of the chat on AC21 portability. Can we trust what Efren Hernandez of INS HQ said? Just trying to find some hope for "laid-off before 180 days" cases.
Any comments, suggestions?
Thanks very much.

Chat User : Fabulous service, Sheela. My question is, what happens if one files I-485 a day or two days after one is laid off? (I-140 is approved while still in service with sponsoring employer)
Attorney Murthy : I specifically asked Efren Hernandez of INS HQ this question on May 3, 2002, at the AILA Annual Spring DC Chapter Conference and he said it should not pose a problem and the person would obtain the GC as long as the INS takes over 180 days to adjudicate the I-485 and the person can show same or similar job classification with a new employer.
