Please clearify if I can file EB2 and EB1 485 at the same time.

Hi all,
Please clearify if I can file EB2 and EB1 485 at the same time, and receive 2 A#.
I have filed my EB2 employee based 485 two months ago, but didn\'t receive receipt notice yet.
But I got my EB1 extradinary I140 approved recently, Can I also file this 485. and to get 2 A#.

Please clearify. Thanx in advanve.

You can only have one A# no metter how many 485s you filed. If you have approved 140 for eb1, you can send a letter with copy of 140 and tell them you want change adjustment base to eb1. By doing this you will keep your old RD/ND. You can even do this by calling IIOs. They will do it for you through their computer, but they will still ask you to send a letter. I did this for my eb2/eb3. Good luck.

At this stage, it doesn\'t matter if you\'re applying under EB1 or EB2 since they\'re both current. Once you file I-485, whether you\'re EB1 or 2 doesn\'t matter. Since you filed the I-485 under EB2 earlier, stick with it. However, if you filed the EB1 based I-140 through your name, and not your employer, then you have the flexibility of leaving whenever you feel like.

Apart from that, I would recommend you stick to the application you sent in. I too did the Eb2 and EB1 thing, but they both came through at the same time. So, I went with EB1 as EB2 wasn\'t current at the time.
