Please clarify - the Terms

Hello Gurus,

What is difference between Hourly , W2 and FTE(Full Time Employee). Is there any difference in above terms? If so could you elobrate?

My LC as far as I know it is on FTE. If INS send any RFE abt paystubs , Can I show them the pay stub with Hourly rate.or they consider the total salary into consideration while evaluting my case?

Could some body explain me pros and cos of this

Hourly / FTE / W2

My guess :

Hourly worker => employer has right to give any variable hours of work and pays by hourly rate.

W2 => generally a contract work. Once the contract/project is over he can remove/stopping providing further work OR may continue with new assignments. Could be paid by hourly basis OR on project turnkey basis.


FTE => You are supposed to work 40 hours per week and employer negotiate yearly salary then the employer breaks that on hourly basis to show on the pay stub.

There are differences with regards to benefits, legal rights, and blah blah..

Just in short. This is what I was once told by some friend long time back.

When there is RFE regarding salary. What INS looks for is past three months earning. if the earning for past three months multiplied by 4 is == to salary mentioned in labor, then you are OK.
(some concession may be there, depends on the INS officer. Generally more salary does not harm. but too less salary does cause problem.)

I know one guy in my office turned from FTE to W2 after he got EAD.
He did so b'coz his wife's company gave better medical/insurance coverage. So he did not want any benefits from his company so negotiated the hourly rate and turned to W2.

He got GC without any RFE.

BUT DON"T TAKE ALL THIS AS GAURANTEED RULE.

W2 means salary with little benfits( SSN and medicare tax paid by company) . If in case of RFE will those companies provide employment verification letter and immigration support? are we have to see our own?
 
Depends upon the company. This should be negotiated with the company. In my friends case, company promised to continue GC process without any interruption.

I changed jobs after 10 months on 485. Got a very good hourly rate. I didn't tell anything to my employer about Emp.letter if I get RFE. But, indeed when I got RFE, I asked them about the letter and they gave me. They just put my hourly rate ($XX/hr) annualised to $XXXXXX/annum. I asked them to mention "on a 40 hrs per week basis" in the letter, which they did. They were not ready to mention FTE/permanent, in the letter. As per the lawyers, anything more than 55hrs/2 weeks is considered to be full time. Hope this helps.

Again, it is how you take it. I work hourly. So, no payment on Fed Hols. No personal time off etc.,

roran - just curious

I am assuming you are into IT(software). What is your skill set? What do you do?

I am in IT in financial applications programming with 9 yrs experience.(C,C++,UNIX,SYBASE)

If one is working on Sybase, it is a given that you are working on financial applications as no other institutions seem to use Sybase. In fact, Sybase rules in the companies at Wall St.

Is it so? No kidding. I thought there was so much uncertainity hanging around SYBASE 'cos of not very good marketing strategy as ORACLE.
After your remarks, I think I don't have to jump to Oracle. Good for me though. No extra taxing of brains.:)
