Guys,

I have this employer who wants to hire me and supports to use one of his pending LC applications ( the previous beneficiary left the company) ,it is aproved at State level and sent to Federal level for processing...

I am thinking to join his firm, because i donot know whether the LC petition gets approved or not? what are the chances it gets approved at the State level and rejected/queries at federal level?

Can somebody show me a way please....

Why don't you ask your employer to amend the pending LC to be on safe side. Employer/Attorney needs to send a request and PART-B of LC application back to Regional DOL.

Regarding chances of getting LC approved, it is in between 0% to 100%. No one can give you any gurantee in this bad economic condition. Hire a good attorney, provide all the required documents and you should be allright.

Thanks for the quick response, Can you explain me little bit more about this AMEND request, i am kind of new to all this..

If the Attorney sends the petition back to regional office again, is it is like starting from the beginning of my greencard and never be a substitution to move ahead filing for I-140 using this old LC pending petition..

Please advise

Amending LC can be done before the application is approved by DOL. It is safer then using approved LC (with someone else as a beneficiery) as long as you fit with the requirements. Attorney/Employer needs to send a request back to concerning agency depending upon where the application is along with updated PART-B of LC application.

It might delay the LC process but can avoid problem/issue during I-140 stage. Talk to your current attorney or someone who is familiar with the process. They know how it works and what employer/you need to do if you want to continue in this direction.
