I am from mexico, currently 31 years old,
back in 1997 my then permanent resident mother (still just permanent resident) submitted a an I 130 petitioning me (i was 20years old back then), the petition was approved and nothing else happened for years

Now almost 13 years later when hope was almost lost, I hired an attorney and he told me that based on the Child Status Protection Act I could get my status adjusted, and so I filled out all the forms , payed all the fees, including a fine (for having been borough into the country illegally when i was a 12 year old)got me a joint sponsor and went to take my biometrics and got my work permit and it was all looking nice...

But I just received my appointment for immigration and my attorney said that my mother must be present at that appointment, and that's where the problem starts, For reasons dealing with My moms current spouse she is not allowed to have a relationship with me and so she did not show up for the interview, My attorney was able to postpone the interview and now i have it on Tuesday July 14th, and my mother says she will come this time (she lives in Texas, i live in Los Angeles CA) and even though i will pay for all her travel expenses and day lost of work, I do not believe she will come, and this uncertainty is just killing me!

I have not been able to marry and have 2 kids born here, many things in my life are on hold right now and I feel extremely stressed out over this situation,

My question would be,
Is it really true that she has to be present at the interview? ( i know my attorney says she has to be, but at the beginning he was not being sure about that and it wasn't until i received my letter with the interview date that he started to insist that she will have to be present).

What options do I have if she does not show up for the Interview?
Should I tell my attorney to not try to reschedule again and just go in and sit with the officer and explain the situation?

DO i have any chances if she does not show up?
Wold my case be denied?
What happens with me if the case gets denied because of her not showing up?
Do i get deported?

OMG I'm so desperate about this situation, please advise!!

thanks in advance

Sam.

What exactly the letter for the interview say? If it says she MUST be there - sorry, but she MUST. If it says nothing (like for most people adjusting in FB1 or 3 category), then I would just go without her.

Im Glad you ask that,
this is what the letter says on the section entitled "Who should come with you?"
If your elegibility is based on your marriage, your husband or wife MUST come with you to the interview.

If you're eligibility is based on a parent/child relationship and the child is a minor, the petitioning parent and the child MUST appear for the interview.

Now Im 31 years old, so I would like to think that my mother does not have to appear, I received all the mailings in my address, she never received a single mailing form Immigration regarding this.

Thanks for your input.
