And If I switch to H4 my H1 (which is valid till Jan 2005) is valid or not. you h1 petition is valid for the period mentioned. incase you want to change to h4 to h1 later then you may either go out of country and come again showing h1 stamp and get new i94 based on that. if you want to change h4 to h1 while being in usa then you have to apply h4 to h1 with change of status (note uscis may approve your h4 to h1 petition but would not allow the change of status meaning you wont get i94 attached to it which means you have to go out and come back in
