Please Advise I-485 or CP for Canadian PR

Hello All,
I am new on this board.
I am a Canadian Permanent resident and working on H-1B here in US since Feb 2001.
LCA approved in May and I-140 Filed on July 15.
Now Lawyer informed we can do concurrent filing of I-485.

I want your suggestions where to go. The service center is Vermont and in 140 I mentioned MONTREAL as consulate will applying visa.
It is only 4 hours from here.
Please advise which one will be fast and safe for me in present situation.
Any idea how much time CP will take.
According to websites Vermont is processing 08/2001's I-485 and 03/2002's I-140.

Please advise ASAP as I don't want to waste time as VSC will be getting bulk I-485s.

Cp will take any where between 5 to 7 months. I- 485 presently taking between 8 to 12 months. If your service centre is taking too long to process I-140 concurrent filing better as opposed to CP and you can also enjoy benifits of I-485. Choice of CP or AOS majoly depends on your personal situation. You may want to contact your attorney regarding this...

My service center is VSC.140 RD July 12.

If some one please respond followings:

1. what is the new requirements for Police Clearance Certificate(Canadian Permanent Resident and Pakistani citizen)

2. I do not have birth Certificates, does only 2 affidavits are enough for both of us(2 for wife 2 for me) Both from Parents.

3. Is there any other requirement other than followings:
a.Tax papers
b. Finger Prints from RCMP(Canadian police)
c. Birth certificates or Affidavits.
d. Marriage Certificate.
e. Medical
f. Photographs.

4. Requirements difference in 485 & CP.

5. Did gov. change rules(more restrictions) on CPs post 9/11.

6. Assuming that 485 can be filed end of september at the earliest by the lawyer. Advise 485 or CP.

7. Never out of status, your advise GC or CP? considering no need of EAD and specially post 9/11 strict regulations.

Please please advise.

Thokoo,

The major point of concern you got to think is how stable is your job in ur company. If you think ur sure you will not loose ur job in less than 12 months then u can decide to through CP as this is faster, but as I said earlier ur the best judge to know the job gurante that will last for that much time. But if ur not sure better go with 485 atleast that way u get the EAD and be safe.

Requirement difference is not significant for485 and CP. Out of status is more of an issue for 485 than I 140. Why do you want to file at the end of september. You can aply 485 now if you have all required docs.
 
4 questions/concerns.

The problems/differences I am trying to clarify here before decision of CP or 485 are:

for 485
I have to send medical with 485 app.
I have to send Birth Certificates with app.
No PCC requirements only FP???(INS will inform about it)

Above will take atleast 1 week and then Lawyer will prepare app and at the earliest I guess it will be filed by last week of sep.

Where as for CP.
NOT CLEAR YET about PCC requirements(all countries lived after 16 OR only Canada RCMP would be fine)???????
If also PCC from Pakistan I have no idea how to get it while in US.
I can do medical before interview(as per this forum) No Problem.
I can arrange BC or AFFIDAVITS by the time 140 approved.If someone confirms that AFFIDAVITs are OK.

The other concern/thought is that, I have canadian Landing Papers and working on H1 in US, will there be a problem with CP etc?

As far as Job is concerned I don't think that it is NOT stable. IT IS, as on today. But you never know. But I dont see any concerns related to Job security.

I am thankful to formerj1, he advised to take BC from Pakistani Consulate, but I am wondering, they will issue me BC (issue date will be current)with my father name only(as per their rules), whereas NVC requires with both mother and father name?(Am I right?).

I guess I confused all of you:
The questions/concerns are:
1. PCC all countries lived after 16 required??(YES or NO)
2. IF Yes to 1 then How can I get for Pakistan & Saudi Arabia(If someone got it and accepted by NVC)?
3. For CP, will they accept BC with current issue Date and only Father's Name.(YES/NO)
4. IF NO to 3, any idea how to resolve.

3. No, it should have your name.
4. Get non-availability certificate and affidavits.
