RFE dated 1/7/03 for BC of spouse
RFE response possibly by feb 1st week (company lawyer)

How log will it take for INS to review my RFE response and take appropriate measures?

H1 expiring on 1/3/03
I have not applied for EAD

What should I be doing ?

H1 extention
File EAD

Was anybody in this situiation before ?

you should maintain the valid status until the approval

my I485 rd is in 10/2001, H1 expiring in 3/2003. i used to think i would get approval before the H1B expires. But my attorney told me i should get my EAD approval or H1B extension approval before the march deadline. so i had applied for first time EAD in 12/2002. i got RFE for this. i sent RFE response last week. we are waiting for its result.

In case I485 or EAD is not approved by end of february i am planning go to the local INS office to get the interium EAD. i am not sure that here (kansas city) they issues the interium EAD.

My sincere suggestion is that apply for EAD to INS, nebraska and after getting the receipt go to the local INS to get the interium EAD.
