Please advice

My RD and ND are Sep 27 and Oct 27 I did not apply for EAD and AP. My HI will be expired April 20 next year and that will be it for my H1. My question is what should I do? Should I cross my fingers and wait for the approval for 485 or file for EAD. Which one could come first? PLEASE ADVICE. Thanks so much if you can reply.

If I were you I would wait till december and if 485 not approved, apply for EAD(Worst case loose $120).

But the point is by then if I still have enough time to get my EAD approved before it expires

NSC is generally good at EADs, I received mine in less than 2 months, in both new and renewal cases.

Apply for the EAD rightaway

It would be better to apply for EAD right away and keep it handy just in case I-485 does not get approved before your H1 expires. You would loose $120, but will have peace of mind that you have something to fall back upon in case our great NSC does not adjudicate your case by then.

Gosh..I can't believe you folks actually

think about $120,etc when it is something as impt as your permanent residency - I just spent a $200 for 20mins with Attorney Murthy,for a consult on matters of AC21
...Folks..this is my advice.. If you can afford it,and I mean that your family will not go hungry if you spend that money,then do it..You got to keep money for times like these,where so much is at stake..like health,food,PR,etc..
as for EAD - bud - don't even think..it took 3months to get my EAD - but even if it takes 3 days..why do u want to procrastinate over something as impt??
A friend of mine was not applying for his EAD,as his H1 was valid for a long time - some 4 years or something..and he got laid off..
and then he had to go to the local office,etc
as for NSC predictions..we have seen those go awry..they have beaten my worst predictions..

so if u can afford it - and spending $120 for something that will allow u to stay in the country(if u get laid off ,God forbid,or in any worst case scenario) ,and this money will still keep food on the table,dont be petty abt it...

I wdnt see it as "losing" (not "loosing" folks :))

but again..that's just the way I think...
