Hello,

I have a few questions. It seems long but they should really have short answers. I would really appreciate all the help!

I have 2-year home-residency requirement. I am on F1-OPT at the
moment and I am trying to meet my home-residency requirement by
spending some time in my home country. I have still 4 months to go
but at the same time I have to spend time in the US due to my work.
I am planning to complete this 4-month duration at home by end of
June 2006 and my OPT ends at the end of August 2006.

My questions are:

1) What documents do I need to submit to prove that I have spent 2
years at home and to get H1-B visa? Is a document from the security
department which keeps track of entry-exits to the country enough?

2) Where do I apply? Immigration office or State department? I know
that in the case of waivers, one should apply to State department
first to get an advisory opinion. Do I also need to get an
advisisory opinion form the State department?

3)how does the counting the number of days spent in home country works towards home-residency sentence? Do I need to exclude the dates of my flights (i.e., the days that I left/entered my home country to commute). How strict is the immigration office in terms of counting these days?

Does anybody know a good immigration attorney specializing in J1-2yr
rule and filing for H1-B visa in Houston area?

4) Is appying for an H1-B as late as mid June 2006 to get H1B until AUgust 31, 2006 enough? My employer will do the "premium processing" which takes about 2 weeks to get an
H1-B?

Thank you very much, in advance!
