Here is the situation.I had filed for GC with my company in Oct 2002 in EB3 category.My wife is working on EAD since July 05.
She has an offer with another company who is willing to sponsor he GC.She wants to be on the safe side, just in case my I-485 gets denied,we have a back-up.
Now,the question is her visa status is AOS(adjustment of status).She is not on H1B or any other visa status.Our lawyer says that since the applicant is on AOS,it is not possible to file for another GC.Please advice
