Hello All,

Thanks for your help in the past. Please clear few more things to me.

My H1 is expiring in dec last week and i am planning to file extension/renewal by Nov first week. Can not do that earlier because my wife is in india and we need her I-94 also.

Will it be OK if i file in Nov first week?

What if i dont get my approval before my H1 expires?

Would I be considered as out of status then?

You will not be considered out of status after you file before expiry and if you have a receipt notice that you have filed before your I94 expiry.

Yes, Nov should be fine for you to file for H1 extension.

You would be fine even if BCIS receives your application for extension of H1b one day before the expiration. You won't be out of status. These time period is considered as pending extension approval, which is always in status.
