Please advice on AC21

Dear Portal members,

I applied for I-140/485 concurrent on 5/5/2003. No reply yet. Due to my company position I had to change the job after 180 days of I-485. I informed INS as per my lawyer advice. My old company ,who filled for I-140, is not going to withdraw the case becuz its virtually shutdown and I still have good relation with the company owner. My current job description is same as my approved labour.

Do you think I might have problem/denial for any reason.

Please advice, as time is passing I am getting more tensed. My I-140 is pending for more then 14 months.

You mean to say that the sponsoring completely out of existance?? If there is any RFE say company's ability to pay how can you substantiate this. Also when you took up the new Job did you transfer your H1-B to the new company or did you use EAD? Because if you used EAD than you have a very high chance of getting a denial in case they send out an RE for company's ability to pay which is pretty much the norm nowadays, and you will be out of status immediately as you EAD/AP/485 will be invalid following the 140 denial.
Please talk to competent lawyer before any RFE is issued.
