H1B Expired Dec 1,2002
EAD Approval Apr 07,2003


I filed 485 Application in Aug 2002 and H1B extension in Sep 2002( Before H1B expiration. i.e Dec 01,2002). I got EAD in Apr 07,2003. Waiting for the H1B extension.


1) If i start working on EAD what will the status for the time period between Dec 1,2002(H1 expire) to Apr 07,2003 (EAD Approval).

2) What if H1B won't come before 240 days or some issues on H1B extension.

my husband is in similar situation - his H1b expired in Jan -we applied for renewal 2 days before expiry - EAD expired March - have applied for renewal. Our lawyers tell us as long as your application for renewal of H1b has been filed you can continue working - if however you are working only on the basis of EAD you have to stop working the day it expires - that is why we had to go ahead and renew H1b - because we knew new EAD would not be in time. So if my lawyers are correct - it seems to me you are fine - but do check with others in the know
We are still waiting for both H1 renewal and EAD renewal
 
H1 Extn gives legal status to work

This happened to me in 2001 - H1 expired Sep 30, H1 extension filed on sep 25 and I-485 filed dec 01. My lawyer said when you file for H1 extension, you are in legal status and allowed to work for 240 days (without H1 approval or EAD in hand) or till a decision is made. I got my iEAD by end of March 02. Still waiting for the H1 applied in Sep 01.
 
I am also in the same boat as you are.
H1 expired mid 01/03 applied for extention 12/02 waiting for renewal.
Got the EAD approved this week, and we are in good shape with respect to status either you are with the same employer or chage it if > 180 days after 485 filed.

It matters, if your EAD expires and change your employer. H1 or EAD it does not make any difference if you are with H1 employer.
