Hi,

I am currently on H1 and I am loosing my job end of this month. I am goin for a substitute GC with a new company, I might have a chance of getting EAD in 2 to 3 months, meanwhile do I need to have H1 with this new company? please advice.

One more question is, there is a roamer going on that EAD will not be issued until 140 is approved from now, is that true?

There are two options for you:

1. The new company while offering an LC for you to substitute
also has a position for which they can do H1 for you.

If this is the case go ahead and ask them to process the H1
first and then use the available LC for filing your I-140 ( file
both I-140 and 485 OR file just the I-140 with CP option ).

2. The new company had just the LC and does not have a open
position right now.

Then seek employment with a different company to maintain
your H1 status. Use the LC of the new company to process your
GC on premise that you would join them on obtaining your
permanent residency.

I cannot comment on your last sentence.

Pleasee Adivse me to file I-140 & 485

My labor has been approved from Philly. Where should I have to apply for I-140 and 485 !!! Can I apply from any center or else I have to go only to a center where my company is located !!!
