Please advice for reinstatement

Hi rajiv,

I was a TVU studewnt and applying for reinstatement. My wife was on dependent visa and she went to india about 2 years ago. I had her SEVIS transfered to TVU in september 2010 when I took admission into TVU. My question is whether I have to include her information in the form I 539 for reinstatement. As she never been in US on TVU's visa was she also Out of status like all of us. please suggest.

A foreigner only has a status while in the US, by definition.
So, the spouse abroad is of course not out of status, since the spouse doesn't have a status to begin with.
