please advice and clarify

My husband left company A and joined company B in
2001.
Company B filed his H1 and applied GC for him. They
didn't file H4 visa through company "B" that time for
me because my previous H4 visa from company "A" is
still valid until Nov, 2003.

Now my husband is in final stages (applied I-485 in
Apr. 2002). He got his EAD and AP.
He applied Advance Parole for me also.

Last month he changed his job and joined company C
using EAD.

Can you please clarify the following Questions:

1. I am planning to go to India for about 3 months. Is
is ok to return to USA using the Advance Parole. Will
there be any problem at POE, because of company B
didn't apply H4 visa for me.
Now my husband is working with company C on EAD.

2. My husband got H1 petition approved from Company B,
but didn't get stamped on the passport. Now he has
changed the jobs and working with company C , using
EAD.
He is going out of country, Is it ok for him to
return to US, using his advance parole. will there be
any problems at POE, because of the old H1 petition
not stamped on the passport.

Can you please clarify the above.

Dont worry. here are my few cents worth.

1. When you have AP and EAD - No need to worry about visa on passport.

2. Take a letter from your husbands current employer -mentioning that you and your husband are going on vacation etc.

3. Take atleast two original AP notices. I assume you are from India. Sometime they take the original AP in India ( Bombay) ( saying its the new policy) and you need an original at the POE here in US.

4. Check with the airline - one stupid airline - United wanted stamping on passport citing regulations in Frankfurt.

Did your husband file for AC21?
Did he change job after 180 days of filing his GC?
Are you also a beneficiary on your husband's petition?

If answer to all of the above is yes then in my opinion you should not have any problem at POE. As BCIS identifies this as a valid status and AP is not company specific it is a supplementary document of I485 process to identify you as legally entring US.

This is not a legal advise, just my opinion, for further clarifications you can ask your husband's immigration attorney.

Can you be a little more specific to me as to what aspects you are referring and what are the precautions to be taken .,pls explain in detail.

I've also recently read on this forum that some airlines (at Frankfurt) are asking for a letter from US consulate that the person with a GC approval stamp on the passport (but no physical card) is a legal immigrant in US and is allowed to enter US and hence board a flight towards US.

I haven't heard about such a thing for personnel carrying AP. But there is no harm to check about this in advance.
