My case has been approved a while ago. And my wife\'s case has been transferred to local office and got interview notice for next week. Before NSC transferred my wife\'s case, they asked the evidence for the last entry to USA from Canada for Aug, 2000. The reason for that is: we had one day trip to Canada using our H1B status (as I understand that a valid H1B status can enter USA from Canada within 30 days through car). When we re-enter to USA, One officer inspected me while another officer inspected my wife. Everything went fine and my officer stamped on my passport while another officer did not stamped on my wife\'s passport. That\'s why the officer in NSC want to see why my wife did not have that entry in her passport and sent us to request evidence. My lawyer sent a Affidavit but NSC transfered the case anyway.
Could you please help me how I can explain this situation to the officer for the interview next week? Is there any specfic law saying that a valid H1B status can enter USA within 30 days without visa?
