I came here to USA in Aug. 2005 for my MS on F-1 Visa and in the month of Sep'2005 got into the worst period of my life. I was new to this country and didn't new the rules. I found a credit card on somewhere in the campus, took it for no wrong or criminal intent. Out of curiosity, used it in walmart for $15 and after realizing what I did, throw it in the trash. I didn't realize that this will cause me the trouble of my life. I was booked for that on the Class 2 Felony and I paid the bond for $500 for keeping me out of the jail ( No jail term ). I, hired an Attorney for that and paid hefty money to save my ass from this as I had no criminal record and sound background.
She pulled this case for 2 years now and few days back she called me as we are supposed to go for Jury trial in September for Class 2 Felony "misuse of credit card". My attorney called me and she said that she was contacted by state Attorney and was said that they are willing to settle this for Class A Misdemeanor" Criminal damage to property" as I threw the credit card. She insisted me that there is no way that I am going to be out of this felony so better to "Plead Guilty". So today I plead Guilty and was given a 2 years court supervision and paid $500 as fine.
I also filled Expungement as my attorney said that what my criminal history gona show is something like this
"Charged will felony- Case dismissed
and Convicted to Class A misdemeanor, Criminal damage to property < $300"
so she said better to file Expungement so that Felony thing will go off.
I didn't serve any jail term and was out of trouble from the last 2 years.
now my question is ..
1) Is that a Deportable Issue?
2)I am going for job and willing to apply for my H1-b next year. Since its not a Felony and a Class A misdemeanor "Criminal damage to Property" , what are the consequesces I will face in future?w
3)What precautions should I take?
4)Since I am still on F-1, so if i go to India, will they allow me to come back?
Please advice me .
