Planning to sue USCIS.....need help???

My I 485 has been pending since Aug 2005 even name check has been cleared in May 2007 which was confirmed by IO many times......they all gave me the same date when my name check was cleared......but still my case has not been assigned to immigration officer yet.

I am planning to sue USCIS. Luckily my employer provide us a legal insurance that covers the attorney fee. My current attorney is good but does not accept legal insurance.

Legal plan benefit website list bunch of attorneys how would I know who to choose and which one is best. Does anyone knows the list of good immigration attorneys or criteria to select one.....?

My PD was current couple of times after I filled 485 still was not approved due to name check and now name check is cleared PD is not current.

First wait is for Labour Clearance and then wait for I-140 and then apply for 485 and then FBI name check and then PD to be current and then it depends on Immigration Officer mood's..

In the whole chain of process there is lot uncertanity and no First In First Out at every each step / process ( where is the justice ? on this ? )

I am getting sick of this when I see approval of others with greater PD and greater 485 application received dates than me there is NO LOGIC to the whole process.

I, too, am thinking of WOM for NC delay for almost 18 months. Has anybody heard negative actions from FBI/USCIS because of WOM lately?
There won't be any negative actions. Unfriendly judge might dismiss your case and you will have to just wait for I don't know how long to get your case adjudicated.

I started drafting my complaint for a mandamus suit, using just the above links, but did not finish because I came across a fine lawyer who asked a pretty small fee ($1,500) for the work and the law firm filed everything for me.

I would say even if you are still contemplating filing WoM stay active in terms of writing letters to senators and whoever you can think of. Those would be very useful later in your WoM suit. And if your PD is current it's definitely worth suing them, pro se or not. :cool:

I have been stuck in a similar fashion since Nov 2004. Our lawyer is asking for an exhorbitant amount. Can you share the name/address of your lawyer please?

Current Status: Approval notice sent.

I just got this in my online status. I will wait till I get the green in the hands and then I will celebrate. The moral: sue the bastards if you want something done. It has not even been 2 months since we filed WoM.

I'll simply cite the attorney opinion i heard: "If you're waiting for less than two years - don't do it". This is correct for i485, citizenship is different. Hope it helps

Thanks a lot for the lead!
I spoke to their Bohemia office and for the first time in 6.5 years I wasn't just jerked around.
The attorneys and paralegals really listen, tell the truth and help a lot!
I wish I could use them from the start - the law firm I had to deal with (because of my employer) managed to screw up every step in the process...
 
I hope they help you get out of this, Azazello. And I just want to encourange people one more time. Even a namecheck should not stop you from filing WoM. FBI were among the defendants in my case and they did not even fight back.
