Planning to apply for Green card myself.

I am working for a company A and not sure how long it\'ll
last. I want get my Green card sponsored by another company B,
though I won\'t be working with Company B. Is it legal. Are there
any pitfalls in this plan that I have to know.

Any advice is greatly appreciated.

Potential Issues...180 day rule...

The core issue to take note: H1 visa and green card are 2 different processes. Before the 180 day rule (that applies to the adjustment of status stage) was introduced, you could just work on your H1 for company A. When the GC is approved for company B is approved, you would "HAVE" to switch to company B and work for atleast 1 year or so for company B. After you complete this period, you can then move on to which ever company/field.

However, when you apply the 180 day rule which says that you can switch from the company that applied for you GC after 6 months of notice of action- I do not know how that would affect your plans. For example, will you be able to switch companies with your EAD card 6 months after company B has applied for your GC? Wonder if anyone can answer that....

Well if I am allowed to pursue my own green card process, I wont have to worry about the 180 day rule or what ever. Green card gurus , please give your suggestions .

You can file through Company B but you will definitely need the company\'s cooperation. Assuming you have the cooperation, there shouldn\'t be any problem since a GC is still for a future position. All that is necessary is to file the Labor Certification and have the company state that they intend to hire you permenently when the GC is approved, if not sooner.

Wife & children Out Of status

Hi,
We had visa upto 15th march 02, so I-94 valid upto 15th March \'02
I changed company and applied for new H1 approval.
We all went India. First I came back to US, got new I-94 valid upto 15th March 02. Now we got my H1/H4 approved on 1st sept 2000, and I-94 valid upto sept 03 with approval notice. My family came from India on 3rd sept, got new I-94 valid upto old date 15th March 02. My question is which I-94 should be considered for family ? Are they OOS ? How do I get new I-94 with date upto sept 03 ? can I go to Mexico ? I am not OOS, should I process my I485 and then family ?
