Pl answer my questions

I have two questions:

1) I heard from my friend that Priority Date(PD) will play a significant
role in issuing receipts and EAD/AP approval. He said that people with
older PD will be given preference than people with latest PDs. Is this
true?

2) He also said that EB category will also play a significant role in AOS
approval. INS will approve only certain number of applications per year and
that number will be divided among EB1/2/3 categories. EB1 & EB2 will have
more percentage when compared to EB3 category. Is this true?

Please confirm. Thanks in advance.

1. EAD processing is not by PD(priority date), instead by EAD Receipt DATE.

2. Yes. AOS is based on categories. EB1/2/3. There are certain numbers in each category and preference would be given accordingly.

my 2cents...

1) EAD is not approved based on PD, it is based on RD. If it is by PD I should have got it long back (my PD is 01/98).

2) As far as I know the EB categories used to be helpful in adjudicating the cases and alloting A#. You are supposed to apply only when your PD falls under your category\'s dates. But as all the categories are current I don\'t think the category plays any role after that. There are lots of EB2 guys still waiting while EB3 guys got approved.

This is just my experience and understanding and may not be true.
