PIO card - Non-US citizens

The indian consulate in New York told me that they cannot accept applications for PIO card from Non-US citizens. He/She should have atleast a GC for applying or else they have to apply from their home country.

Is this true? Any experiences at other Indian consulates?
 
That is not true. I am a canadian citizen working on H1B. I was able to get my PIO card from New York in July 2003.

Are you saying that parents with GC only can apply for PIO for their US citizen kids? Parents with H1 or at AOS stage can not apply for PIO for their kids?
 
some more clarification

If parent have Indian passport then there is no problem. If both parent of the kid are non-us citizens on temp visas then there is a problem according to consulate staff. However Vajpayeeji would disagree,
