Physical presence for Citizenship Requirements for GC holder through Asylum

Hello Forum friends,

I have question, does it our travel time out of country count against our eligibility time for citizenship? Let's say I am eligible to apply citizenship application on 4 years 9 months. I travelled 3/4 times during this period, will those stay outside of US will adds up in my eligibility date.

Let me make question simple, my GC was issued on April 19, 2007 Resident since April 19, 2006. When will I be eligible to apply for citizen? I travelled 3 or 4 times during this period and stayed out of US for totalling 11 months.

Can I apply the citizen on January 18, 2011 (4 months 9 months) or I have to add those 11 months before I apply the citizenship?

Short trips are ok. As long as no stay of yours is 6 months or longer, you should be ok. You can apply 90 days before April 19,2011 and not 3 months. It's not the same. Even one extra day can cause you problems. Apply January 21,2011.

Thanks for quick posting Wantmygcnow! Each of my trip was just little over 3 months (less than 6 months). The one trip I am going have will be 4 months. Therefore I am ok to apply for Citizenship 90 days before.

By the way last year I did two seperate trips totaling 7 months( each was 3.5months) if this make different in terms of eligiblity.

No they dont make a difference. You are ok.

I was about to ask the same question. My oversea travel period was just one month, so I can apply after 4 yrs and 90 days without counting this one month period? I have checked the N400 form and you do need to list all the days outside US. Anyone has a formal reference states that oversea stay less than 6 months doesn't count to the 4yrs and 90 days requirement? Thanks a lot

Hi Taydawgg, you can apply 90 days before the 5th anniversary on your GC not 4 years and 90 days as you said.
