- AILA sources reported that the USCIS had rejected immigration photos if the photo showed the person smiled and mouth opened. Ever since the immigration photo instruction changed from the side-view to front-view, the USCIS appears to strictly follow the State Department passport photo instruction, which requires the mouth "closed" and not to smile if it makes the mouth opened. The instruction says it prefers that the person does not smile at all. Uh?!
- Whether one likes it or not, people should strictly comply with this requirement as rejection of the photo can result in serious consequences in some cases. For instance, people who file EAD extension close to expiration of his/her current EAD needs the renewed EAD in his/her hand before the current EAD would expire. Once photos are rejected in the paper filing, it can delay the issuance of EAD renewal. Watch out! Don't smile!
