Petition through immediate relative--will he be punished?

When a person overstays for more than 6 years, will he/she be punished for it when the petitions (i-130, 485, 765) are filed? Given that he/she is under 21 years of age and unmarried.

Another question I have is I understand one can apply for a SSN after receiving a work permit, but will that person be able to use the SSN to apply for health insurance? Will that person also be able to use the SSN to apply for financial aid to help with going to school (while working, of course.)?

I hope I'm not wrong but people under the age of 21 can file for I-765 along with I-130 and I-485, right?

Need as much information and advice as possible. Thank you very much.

No.... he won't be punished, at least until he gets married while petitions are pending. How old is he? :confused:

You need to file the petitions as soon as possible, because he can age out of the process before the greencard is issued to him, and makes his life more difficult. All the forms you outlined are correct. If he is 18yrs of age, then you can apply for EAD (1-765) for him, and once he issued the card, it can be that he can apply for social s. card, which might be or not be issued until he can prove that he is a greencard holder.:p

As long as he is a relative of a US citizen, all his previous indiscretions are forgiven: visa overstay, working illegally and other minor issues, except when he killed a hooker, stuffed her with cocaine and ate celery with biscuits on top of her lifeless body....:eek:

Very important: you should NOT apply for Advance Parole at all. He needs to ensure that he stays in the US until he has his greencard, physically in his hands or if he leaves on a AP, he going to be barred from coming to the US until 2017. :rolleyes: So, apply for his greencard and EAD....

He won't be punished at all for overstaying his visa...:( Only exception, if he ever stayed at a holiday inn during his visa overstay, he might be punished..:eek:... and his punishment.... cleaning the Taco Bell in Village of NY of all the KFC rodents...:rolleyes:

He is 18 years old about to be 19 in 4 months!

Thanks for all the info! I was wondering about the AP too. Now I know better.

What I didn't know was about the SSN thing. I thought everyone could get a SSN after they got their EAD. :confused: :mad:.

So does anyone know about the health insurance/school thing with SSN?
 
They do get SSN after EAD. His overstays will be forgiven. He is not to leave US until he has actual green card.
 
You're not often wrong Al, often weird yes, but wrong no. However this time you are: if you have an EAD SS will give you a SS number. Oh well, a 99% record is still good. ;)
