Petition on Earned Legalization

Hello, All,

As many of you, I feel frustrated at the slow process of GC. Due to this as well as the laid off resulting from instability of US econony in the last few years, I had to start my GC all over again and meanwhile am faced with the dilemma of H1B 6 yrs ending. I am considering if there is a way we can make an appeal to sb. (say the Head of BCIS) to ask for granting us the green card based on earned legalization, i.e. we have stayed here long enough, made great contribution to the country, proved ourselves to be a valuable asset, paid tax, stayed legal.... We should have gotten our GC if not for the slowness of the processing, the instability of US econonomy and unreasonableness of immigration law (had to start GC all over again when you switched company unless you are in I-485 stage).

So, has any one attempted to do this? Whom shall I write to?

I no longer want to be one of the silent sufferers :-).

Earned legalisation,as a concept is introduced in the bipartisan immigration reform act recently introduced in the congress
of course it has a long way to go for getting passed into a law
refer to s2010 immigration reforms act 2004 introduced by
senetors Chuck Hagel (R-NE) and Tom Daschle(D-SD)

If one looks at the wordings it looks like it is meant for undocumented /illegal workers (one needs to really look if that covers the case that you have outlined)

In other words ,one has to become illegal to claim that provision even if it becomes a law

therefore the right people to be chased should be the the

5 Secretary Tom Ridge
6 Secretary Colin Powell

Fact sheet of the earned legalisation clause --
part of the Bill S2010 introduced in the senate

The relavant portions of the Fact sheet of the bill (not yet become a law)is given below

Opportunity to Become a Stakeholder: Finally, the legislation would provide an opportunity for undocumented workers and families currently living in the U.S. to become invested stakeholders in the country if they can demonstrate that they have met all of the following requirements:


• Passed national security and criminal background checks;


• Resided in the U.S. for at least 5 years preceding the date of introduction;


• Worked a minimum of 4 years in the U.S., (one of which must occur post-enactment);


• Paid all federal taxes;


• Demonstrated knowledge of English language and American civics requirements; and


• Paid a $1,000 fine, in addition to required application fees.


Individuals who qualify for this program will submit an application to the Department of Homeland Security (DHS). Upon approval, DHS may adjust the immigration status of qualified applicants.
