Innumerable delays in Labor Certifications in Region VI DOL-SFO

I am writing in regard to the Region VI Department of Labor processing times During this period, RIR applications in California have been pending for more than two and half years. This is a simple and true fact that should not be overlooked as you formulate your policies for the labor certification program. I believe that it is unfair for the Department of Labor to delay the RIR component on all applications of businesses in California

In order to compete in this business we seek out employees who possess skills that are not widely available. . Recruiting and retaining employees with these skills is critical to our business. The reduction in recruitment labor certification program has been of great benefit to our company because there have been times when the only available worker with these skills was a foreign national. They improve Californian economy by creating jobs for us workers.

I truly believe that U.S. workers have not been disadvantaged by the reduction in recruitment labor certification program as it is applied to the applications we filed during late 2001 and 2002. We are committed to the employment of U.S. workers and make every effort to place U.S. workers in our technology related positions. For our business, however, we must identify people with the skill sets required to perform the job. There are not always U.S. workers for every such position.

Region VI of the U.S. Department of Labor
Ø Region 6 processes other western states except California two years earlier
Ø Why are Californian workers and businesses unfairly treated?
Ø California DOL has forwarded the applications to the DOL BACKLOG ELIMINATION CENTER who have had numerous software problems so the long suffering LCA applicants have after a wait of two and a half years have nothing in way of acknowledgement
Ø Consequences to the bay area companies are wasted time and effort and money.
Ø Immigrants are high tech workers and contribute to the creation of jobs and revenue to the State of California. They deserve to be treated with a little more respect
Ø If Californian high tech workers leave the valley which they have to do since the California dol is slow and unfair,they will take away with them the jobs they create and revenues to the state .

In short, I respectfully request that you reconsider the plight of technology workers and improve the DOL efficiencies in California so that they are as efficient as other regions in the country
