petition for parent

i am turning 21 in august and will be eligible to petition my father then. my dad is remarried and has a one year old son with her. my 18 year brother also lives with them... will my father be able to include them in his petition? if so will they go through the process together and will my older brother have to be filed seperately??? or will he have any problems??
 
NO. It sepends on your definition of problems. If you want them in the US quickly, yes you have one.

Only your father (unless his wife became your stepmother some time ago) qualifies as an immediate relative; even if your stepmother qualifies as an immediate relative, your stepbrother would not. None (except your stepmother is she qualifies) of them may immigrate with your father. Check the USCIS website for the family based immigration information and the Department of State website for priority dates. You may file for your brother; is wait depends on his country of birth; your father may also file for him and it will depend on his age when your father files for him. Your father may file for his wife and infant child after becoming a LPR; their wait is an additional 5 to 6 years after LPR received.
