my father was petitioned by his brother before i was aged 18, his petition papers finally arrived in 2001, can i use his petition papers because i am now overage
yes i am included in the petition, i was not overage during the filing, but it took a long time to process the petition, 12 years or more. When the prtition pushed through, i was overage. If anyone could give some advise i will highly appreciate it.
You might want to search and read on the Child Status Protection Act. Your situation is similar to mine and I recently received my GC thanks to this law. I was under 21 when the petition was filed but over 21 when it was approved.
I have same problem. My grandfather filled my mom's pitition with my name & i was 17 at that time. It takes 5.3 years for approval. it will yet take year & a half for available current priority date. i will cross 21. can i go with my mom ? what is the prosiger for CSPA ?
By the child protection act it's my understanding that the a person who has a petition filed on his/her behalf before turn 21 years old then is consider a child.

I'm at similiar situation... My parents just receive their green card through employement. I'm 25 right now and unmarried. When they apply they did include my name as their child in the form. I was under 21 for sure then and I was in US too that time with F1 visa if it's rellevant...
I'm not sure which form do they use to include my name. I will try to look for it tonight.
So what should I do guys... Is there still any chance that I can be include in Child Status Protection Act and get a green card also?
USCIS does not recognize separation as a legal divorce status.
You would like to check out with a lawyer. I know that on the pdf file that is attach to the link (in the part that it says Child in bold blue letters) there are several examples and one if the child married but then get divorce.

Like I said earlier when my parents start applying (from employement) I was under 21 for sure... they just got their green card a week ago and I'm 25 right now.
I'm pretty sure that when they apply, they did include my name somewhere in the application (i don't remember which one) as their child.
My cousins had been called for interview. His situation is similar. He was under 18 when his petition was filed but now he is 33 but unmarried. Please let me know if there is any chance that he will get GC

I don't think they've ever applied I-130... 'cause I-130 is for PR or USC sponsoring their relative... and they weren't PR yet at that time, so i don't understand if they should've apply I-130 for me back than...
