petition for my brother...help pls!

hi all...i recently became a US citizen and want file for my brother's green card (I-130 etc) who is an unmarried adult (over the age of 21). here are my questions:

1) since i m a US citizen, i can apply for him and he will fall under prefrence 4...any idea how long the wait is for immigrants that fall in prefrence 4?

2) my parents are legal immigrants (green card holders) but not citizens. Since my brother is an unmarried adult, my parents can apply for him too n he will fall under prefrence 2...any idea how long the wait is for immigrants that fall in prefrence 2?

3) what happens if my parents apply for him but before he gets his green card he is married? wht happens to his case?

4) can we file two petitions for him? one through me (as a brother) and one through my parents? (as an unmarried son)?

your responses will be greatly appreciated cos it will help me decide how we can proceed with his petition...

1) and 2) See the visa bulletin which shows the cutoff dates for people who are currently being approved ... as you can see, the wait is more than 8 years for both preference categories.

3) If your parents are not citizens, his case will be revoked as a result of the marriage. If they are citizens, he has to apply to get downgraded to third preference and have the new wife added.

4) Yes.

Be aware that while these are pending, it will be more difficult for him to obtain a tourist visa.

how about using cspa stuff for age out scenario...

I have similar situation... where my son aged out from FB4.

How do i determine if CSPA can work for him...

his DOB - 28 july 1983
date we got interview - August, 2006

can he able to file under cspa?

Aging out after already applying is a very different scenario from the original post in this thread where the potential beneficiary is already over 21 before applying. Start another thread so you can get some relevant answers for your situation.

i m curious wht prefrence will USCIS will treat my brother in? on 3nd or on 4th if we have two seperate petitions filed for him at the same time?

Both petitions would remain active, and whichever one has the priority date become current first is the one they will likely select first to complete the AOS or consular processing.
