Career hardships –
 I work for a major Defense contractor specialized satellite communications. My technical expertise is extremely beneficial to Homeland and National security. However, my I-485 petition has been pending at Vermont Service Center for 12 months. I’m not treated fairly at workplace because of my alien status and even worse, the delay has impacted my personal life drastically. At workplace, I have to carry different color badge, indicating my status as a "foreign" person. I am only allowed to enter through designated entrances and exits and have access only to my own office and a lab. Due to all the physical restrictions, I cannot visit the in-house cafeteria, unless escorted by a US citizen. Because of the backlog, I have been working on H-1B for six years and seven year extension by AC21, two I-140s (approved, one was amended) and also a year waiting on I-485 petition! There is not genuine recognition or promotion at work because of my immigrant status. My wife cannot get driver license for a second year in a row because she is on EAD, by Pennsylvania state law, she can’t have driver license or learning permit. I have to drive her to work and home everyday. Stress, anxiety and anger are part of our daily lives. The multi-year process delay results in no sense of security as my family have been treated like "guilty" always though we are innocent, hard working and talented foreign workers.

EAD inconvenience –
 I am a software architect for a fortune 500 company. I have been waiting for my EB I-485 adjudication for 20 months. Recently, I had a bad car accident that damaged my car. I decided to buy a safer car. Unfortunately, the bank would only give me a months as my EAD expires in 6 months. Not having enough money for monthly payment, I have to take bus to work everyday. I cannot work late, and have to lose couple of hours everyday trying to catch the bus. Approving my I-485 petition timely would have prevented these hassles. I strongly urges BCIS clear the 485 backlog and extend the EAD validity to multiple years. The difficulties in providing bank loans for EAD workers have affected the US auto and financial industries greatly.


Frustration of contacting NCSC
 I had a frustrating experience in contacting NCSC, the newly centralized customer service for applicants to get case status. I have a Dec/2001 RD case, which has been pending for nearly two years. I called NCSC in June, at that time, the published processing time was 18 months, but NCSC operator who answered the phone insisted the processing time was 19 months and asked me to call back in July. The operator had little knowledge of immigration policy. Instead of asking for my case number, she said what is your green card number. Without knowing my case number, she said since your case is still pending, you need an interview. I was very frustrated in the end when the opeator refused to send a status request to Vermont service center. A month later, I called NCSC again, this time the phone operator said the current processing time is 24 months, call back in Dec, which is inconsistent with the published processing time. I finally reached someone reasonable and she took down my name, EAC number, address and promised to send me a case update letter in 3 to 4 weeks. But 7 weeks have passed I haven’t received anything from the service center. The operators who answer phones are not trained with immigration knowledge. Most of them are rude, impatient and inconsistent.
 I called NCSC, and the phone operator asked me to seek physical therapy, don't bother calling him. The whole delay has already caused great mental distress for every applicant, not mention such poor customer services, which is in conflict with BCIS's goal, improving the immigration system. What a waste of tax payers' money for this kind of inferior service, and yet it represents the government of a superpower country.


Children's education affected –
 I filed EB1 I-485 petition at Nebraska Service Center back in Oct 2001. I have two daughters who graduated from high school with GPA of 3.98 and 3.99 respectively. They were both rewarded merit based scholarships to study at Univ. of Michigan. However, since we are waiting on green card approval, the two daughters were told that they would not be qualified for the scholarship. The girls had to apply for student loans and since they were not be able to pay the debts they have to stop studying. The young kids' hearts were broken and so did us. Because of the strict security check and technology alert policy, our cases can not be adjudicated in time. BCIS's unaccetable delay has affected thousands of innocent children's lives, who become the victims of the backlog.
 I am a California state resident. I filed my case in Feb 2002. My daughter will go to a university this fall. However, her financial aid application was rejected because she was not a permanent resident and therefore not qualified. For illegal students, DREAM Act and Student Adjustment Act may help them to get financial aid. But for legal workers and their dependents, there're really no hopes.


Second fingerpint pain-
 I am a New Jersey state resident. My case receipt date is 10/01/2001, so far I have not heard anything from BCIS while others who filed cases same time as me have been approved months ago. I have already filed for third EAD and second Advanced Parole last week. Last month after calling NCSC I got a response said "First fingerprint has expired and BCIS has sent a notice to the applicant, and should complete it in order to get his application processed". Almost 8 weeks have passed since then, neither my lawyer's office nor I have received the notice. I have to contact local congressman office for help. I wish BCIS update the online case status with appropriate information when fingerprint notice is issued. Some applicants have reported that while primary applicant received second fingerprint notice, beneficiary applicant has not. This inconsistency has brought great pain to all EB-based applicants.


Service Center error –
 I applied I-140 in Feb 2002 and got approved in May 2002. I filed I-485 case in May 2002. My company changed name after I filed 485 but remained same tax ID. My lawyer suggested me filing an I-140 Amendment for company name change in July 2002. In May 2003(almost after 10 months) I got I-140 amendment RFE requesting that "provide legal doc to show company name change happend legally". RFE response was received by BCIS in the first week of June 2003. In the second week of 2003 BCIS denied my former approved I-140 stating that Employer try to substitute new Alien for the Labor Certification, which in turn denied my I-485 petition, which is soley a mistake. In the fourth week of June 2003 my I-140 Amendment got Approved. I then filed MTR(Motion to Reopen) in July 2003. Because of this severe Service Center error. I am going through tremendous pressure and anxiety. everyday. I haven't heard from BCIS ever since and is seeking congressional help.


Local Interview Nightmare –
 I filed my I-485 case in Nov, 2001. My case was transferred to Buffalo district office on July 18, 2003. I received a notice from Buffalo local office dated August 25, 2003 which reads as follows: "The application for permanent residence you filed has been received by the office listed below for processing. Once All processing and background checks have been completed, you will be scheduled for an interview to discuss your application. The normal processing time for this type of application is 9 months. Please do not contact this office unless you have received a notice of interview by May 21, 2004." Moreover, the Buffalo local office assigns a new case number to my case with the Receipt date August 25, 2003 not the real RD which is November 19, 2001. After 21 months of long waiting, yet I have to wait nine months more for the interview. This is devastating news to my family. I urge BCIS to expedite I–485 interviews at local offices. An interview won't take more than 10 minutes and I have been waiting for my green card adjudication for 21 months.

Too many errors

Please don't take it bad, but there are too many sentence formation errors in the above Appendix. Ofcourse i know that you have always admitted that you are no english Guru.
I am working on the corrections and i will post it in the afternnon.

I basically copied whatever ppl wrote and did some small modifications. You can change it, but are you sure you're an english guru? There were many mistakes in your petition draft too, Rajiv has corrected them. Some of your grammar sounds incorrect to me. I don't think grammar is that important in this section. It's not writing contest, but real words from real applicants. You can't expect every applicant has perfect english.
If it's too perfect, then it sounds like polished and faked.

Look at AILA phone survey for the personal statements.

You spent too much time on polishing words and waiting other ppl's opinions. When can you actually get the petition posted and signed? We want see immediate actions, not waiting several months for BCIS director to pick up our petitions. They won't even notice a grammar error in the appendix, I suppose they won't read carefully like we do.

Timing is more important, please don;t waste time on correcting small errors but miss the big picture, that is, we have to get this petition out ASAP.
 
I think the stories that are put in the appendix are not very emotional except the one that talked about kid's education. The stories should be touchy and movable. In my opinion, the appendix would not add anything to the petition.

Looks like you felt bad when i said that there are too many sentense formation errors. That's why i started my previous post saying 'please don't take it bad'.
I agree with you that minor english errors do not count much when you are putting personal stories together. That is one reason i never bothered to take a look into Appendix B that you have been presenting for sometime. Today i wondered why Rajiv has not yet appended Appendix B to the main letter. I wanted to check out if it is ready for inclusion in the main letter, so that we can request Rajiv to add it to the main letter and post the Petition by end of today. That's when i figured out that Appendix B needs some corrections before we ask Rajiv to append it. I don't think we can expect rajiv to spend any more time redoing the letter after he spent so much time on it. Let's make some quick corrections and ask Rajiv to append it.
hey, don't get mad with me for saying that you are not an English Guru. We are all working under tremendous pressure and urgency and sometimes we won't be able to express ourselves in proper words.
 


Let's move ahead. I always feel that contents doesn't matter, even If we send BCIS one line petition describing the hardships faced due to their slow processing speed and requesting them to take immediate action to resolve that problem with thousands of signatures would go long way than sending a very well written petition with few signatures. So let's concentrate on basics and move ahead than arguing on each and every step.

Due to all the physical restrictions, I cannot visit the in-house cafeteria, unless escorted by a US citizen. I am only allowed to work from 7:00 AM to 4:00 PM and this prevents me from utilizing the company's flexible hour schedule. There is not genuine recognition or promotion at work because of my immigrant status. Due to the nature of the State Department Export License, which is for a specific project I have absolutely no flexibility to work on other projects or even be consulted on anything else.
My wife cannot get driver license for a second year in a row, because she is on EAD. By Pennsylvania state law, she can't have driver license or learning permit. I have to drive her to work and home everyday. The time spent I have no other choice but to use it as vacation time, since my limited time permission in the building does not allow me to make up for this time. Stress, anxiety and lack of security are part of our daily lives. I have edited it and tried to trim it to two pages (i have cut a few minor points) , but Cinta's latest changes would not allow me to fit everything in 2 pages. If Cinta can reduce his story by a few lines, it looks more readable. I leave it to him to decide.

dsatish, I could do that..I have been very busy with personal issues..give me some time, until this afternoon.

dsatish, I took a look. It is about 20 lines longer than two pages. No need to modify. Better leave it like this and expand; keep adding on page three and beyond.
