Permanent Residence Application - Primary Applicant in USA , Spouse in India

This thread talks about all the issues related to couple where , they have applied to Permanent Residense and primary applicant is in USA , but spouse is in India.

For some reason (like did not get USA visa) , spouse is in India only.

What happens to PR application in this situation?

Then spouse medicals/security will be done in India??. If yes how it may effect the processing times of that joint application.


Any comments /suggestion about its effect on the processing time of that application.

one of my friend applied with that situation. His application got approved with an interview at Detroit center. He went for the interview (they asked for both of them to attend) and explained that she could not come as she did not get the USA visa.

The approved the application. The only trick is that you have to get the passport of your spouse. This is tricky as mailing passport is probably illegal. And carrying other peoples passport is tricky too. Do not ask me how my friend did this part but you gotta do it as you have send the passport here for stamping.

I think in this case, my friend'S spouse was lucky to get approved. I believe no matter whether spouse can come or not, the principal applicant will get approved. Once you get approved you can always apply for your spouse.

So, if I was in your place, I will always try as my friend tried. Good luck.
 
Legal to send with someone as long as you have an authorization letter

I think India is one of the few countries which still does not allow a passport to be sent by mail (Similarly it is one of the very few countries left where there is immigration control when exiting). I think in such a situation it would be OK for your wife to send it with someone as long as she gives the person an authorization letter. This will have to be done both times to get the passport here and out.
Another thing which puzzles me is that the Canadian authorities request passport from ppl already resident in Canada so I guess they must be sending it in the mail too.
I am guessing you are on H1. So your spouse would come here on H4. Why do you think she may be denied H4 visa ? Is there something concrete in her past which makes you uncertain ? I would suggest you cross the bridge when you get to it .

Can't her spouse mail her passport from India to Canadian Authorities in India or in US for Visa to Canada?

It's Illegal

By law it is illegal to mail an Indian passport across national borders (ie between countries). Dont ask me what happens if you get cought because I dont know. But the law is that you cant mail.
 
Agreed that you can't mail Indian Passport out of India.

How about mailing Indian passport to Canadian consulate within India though your application was approved in US? Can they issue PR visa in India?
