PERM reconsideration withdrawal

Hi,
My company filed for PERM application in 2005, which was subsequently denied in Dec 2005 (due to what we feel was a system error). Subsequently my company filed for a PERM reconsideration in March of 2006, for which we have not yet heard anything on. No judgement has been passed as of yet on the PERM reconsideration, but we would like to completely remove it from the reconsideration process, as we are not interested in this PERM application at all.

Could you please let me know what is the procedure for doing so - i.e. what is the way to remove an application from the PERM reconsideration queue? Would sending a letter to the CO (certifying officer) be sufficient?

I am in a similar situation, my PERM LC was denied since the HR changed and PLC Atlanta kept contacting the old HR. We opened an MTR in early March of this year giving them the new HR info., to which they responded in late August (still cc'ing the old HR) and the attorney (fortunately) asking the company to send a letter stating they indeed had filed for the LC.

The company sent the info. about 2 weeks ago. I am still waiting to hear from them.

What was the denial reason in your case? I think they will get back to your MTR....just that they are quite slow. In order for you to withdraw ur reconsideration, first the HR will have to send an email to PLC Atlanta telling them that they are no longer interested in pursuing that particular LC. In all likelihood PLC Atlanta will say they are OK with it, after which the company can file a new one.

However in some cases, PLC Atlanta reserves the right to say, we won't let you withdraw the case since we are close to reaching a decision on it. Let me know if this helps.
