PERM: one of the alternatives?

Hello everyone:

My NIW is denied (need to appeal, though) and my employer does not want to sponsor my GC. My H-1B expires this coming Oct. I may have to leave current employer and find another job for this, of course. Is PERM one of the alternatives that I can choose to stay in the U.S.? Anyone knows if I'm safe (too late) to apply for PERM and GC? How long it takes to get the PERM permit or EAD card? Any comments are welcome.

Your 6th year will be expired this Oct ? If yes, the only chance is NIW appeal or pack to GO HOME.

You still have 7 months. You still have a ray of hope. File PERM ASAP. It takes 61 to 75 days to prepare and file PERM after you receive your PWD from your State SWA. It takes 45 to 60 for PERM approval after you submit the PERM application. (i.e. if you ar lucky assuming you dont commit any mistakes while submitting PERM 9089 form or assuming you dont get audited or denied automatically).You can file I-140 soon after PERM approval. Nowadays most I-140s are getting approved in a few months (1 to 3). If you get your 140 approved, you can get 3-year H-1B extension beyond the normal 6 year limit. However, note that you will still need support of your employer to file PERM. Since your employer is not supportive, find another job ASAP.

If I get a job offer in May, do you think I still have a chance to get stayed in the U.S.? I'm teaching at university (with Ph.D.). Based on what you said, it would be difficult to get I-140 approved before Oct. this year. Am i right?

Are you from a retrogressed county? If not, you can file PERM under EB2, get labor approval, file 140 and4 85 concurrently and get EAD (work permit) which you can use instead of your H-1B visa. You should start ASAP. It takes a minimum of 61 days to apply PERM after assuming you will get your PWD from SWA within a few days to a few weeks.

No, I'm not from a retroprogressed country. What do you mean by "a minimum of 61 days to apply PERM?" Is that from the date that job search advertising is appeared on newspaper or Web site?

It takes at least 61 to 90 days to prepare and file PERM application (all recruitment steps such as newspaper, online ads, campus placement ad, PWD by SWA, etc fall within these 61 to 90 days).
