PERM new employer v/s BEC

Hi,

My LC was filed in california, EB3 PD 10/2002 and has been transferred to the philly BEC. Initially I was hoping I would get it approved by june/july 2005.
But from what I read here it might take even a year more??

Now I have an offer from another reputed employer who is willing to file EB2 PERM (I have MS + 7 yrs exp, Software engineer). Am I better off taking that? In best case I could get my GC in one year!

Any opinions? thanks
 
GC in 1 yr with PERM

1 year estimate for GC through PERM:
3 months pre work, 2 months for approval
right now 140/485 is taking 6 months for approval in CA
so 11 months best case GC according to current situation.

MS+7years might be way too overqualified for the position of software engineer (ETCC being BS and SVP being 7-8). Ask your lawyer if showing both business necessities will be a risky route.

The lawyers say shouldn't be a problem, ofcourse no guarantees.
The employer has filed EB2 perm for similar positions before too.
Any opinion on whther I should wait out the BEC and hope 485 doesn't retrogress further or just take the risk with PERM?
 
i would wait. there are too many issues with perm. read the bulletin board. once u get past labor, the rest is cake (comparatively). plus u cannot apply in EB-2 no matter what u do, unless u're a manager. if ur lawyer says u can do EB-2, they are lying. consult another lawyer 2 make sure of ur case.
