Hi,

I Have applied for PERM in May 2006 and 9 months later I got denied with the reason of Education and experience, My employer applied a new one again in April with MS+0 yrs or BS + 2 yrs application and the DOL has sent an Audit requesting the business necessity for Master's degree on Sept 30th, My employer replied the case on Oct 25th with the necessary documentation for business necessity and I am still waiting on the Approval. My question is how long will it usually take for DOL to take a decision after the Audit documentation is submitted? Will my previous denied application anyway affect the current application? Is it absolutely futile to hang on to my current employer with this kind of scenario with out switching or do I have any hope of approval? I really appreciate any replies.

Business Necessity

Hi Couple of my friends had audit request on Business necessity
It all got approved 45-60 days after they responded to audit.
the response letter will have to be carefully thought.
Hang in there..audit has been common these days.

Re: Audit Time Frame

Hello,

We just had a case approved last week for an audited that was filed in July 2007. However, we still have one from August that is still pending. When status queries are placed, the generic "we're working on it" response is sent. If you have another denial, why not try going through an attorney's office, since it seems something is not right if you get a 2nd denial.

Good luck,
